We believe privacy information should be understandable.

This Privacy Policy explains what personal information Localblend collects, why we collect it, how we use and disclose it, and the choices available to you.

Localblend is a registered Australian business name operating under ABN 64 609 878 035.

Where privacy laws apply to us, including the Australian Privacy Principles, United States state privacy laws and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), we handle personal information in accordance with those laws as well as this Policy.

1What This Policy Covers

This Policy applies to personal information we handle through:

  • our website;
  • the Localblend application;
  • the Reply Assist browser extension;
  • customer support;
  • sales and account administration;
  • connected third-party services; and
  • other interactions with us.

It covers information about account holders, authorised users, prospective customers, website visitors and other individuals whose information may be processed through the Service.

2Information You Provide Directly

Depending on how you use the Service, we may collect information such as:

  • your name;
  • email address;
  • telephone number;
  • company or business name;
  • job title;
  • account credentials;
  • billing and subscription information;
  • communications with us;
  • support requests;
  • preferences and settings; and
  • content you submit through the Service.

3Information From Connected Services

If you connect the Service to a third-party platform, we may receive information made available through that connection.

Depending on the integration, this may include:

  • business profile information;
  • location information;
  • reviews, ratings and related metadata;
  • reviewer names or publicly available profile information;
  • messages or responses;
  • account identifiers;
  • integration tokens and permissions; and
  • other information the connected platform makes available to us.

The information we receive depends on your permissions and the third-party platform's API and privacy settings.

You can generally revoke a connection through the relevant platform or through Localblend, where supported.

4Customer-Provided Information About Other People

Our customers may submit information about their own customers, employees, reviewers, prospects or other individuals.

In these circumstances, our customer is responsible for deciding why that information is collected and for ensuring it can lawfully be provided to us.

We process that information primarily to provide the Service requested by the customer.

If you believe a Localblend customer has provided us with your information and you wish to exercise rights relating to that information, you may contact the relevant customer or contact us at [email protected].

5Information Collected Automatically

When you use our website or application, we may automatically collect technical information such as:

  • IP address;
  • browser and device information;
  • operating system;
  • pages or features accessed;
  • timestamps;
  • referring URLs;
  • application events;
  • error logs; and
  • security and authentication events.

We use this information to operate, secure, analyse and improve the Service.

6Cookies and Similar Technologies

We use cookies and similar technologies for authentication, security, preferences and application functionality.

Some cookies are necessary for the Service to operate.

Our own website measurement does not use cookies and stores nothing on your device. It runs on our servers, shortens your IP address before storing it, and recognises a return visit only within the same day. That is why you will not see a cookie banner on our website. Website measurement data is deleted after 12 months.

Where required by applicable law, we will request consent before using non-essential cookies.

You may be able to control cookies through your browser settings, although disabling essential cookies may prevent parts of the Service from working correctly.

7Payments

Payments are processed by Stripe.

Payment providers may collect payment-card and billing information directly from you.

We do not ordinarily receive or store your complete payment-card number.

We may retain transaction information such as payment status, subscription level, invoice information, billing address and limited card metadata supplied by the payment processor.

8How We Use Personal Information

We use personal information where reasonably necessary to:

  • create and administer accounts;
  • provide features you request;
  • operate integrations;
  • process subscriptions and payments;
  • provide customer support;
  • communicate about the Service;
  • authenticate users and prevent fraud;
  • detect and investigate misuse;
  • maintain security;
  • diagnose errors and improve performance;
  • understand product usage;
  • develop and improve features;
  • comply with legal obligations;
  • enforce our Terms; and
  • protect our rights and the rights of users and third parties.

We do not sell personal information.

9Artificial Intelligence

Some Localblend features use artificial intelligence.

When you choose to use an AI-assisted feature, the information needed to fulfil that request may be provided to an AI service provider.

This may include prompts, business information, reviews, text you provide and other relevant contextual information.

Questions you ask in Help inside the application are answered first by an AI assistant, which can pass your question to a person on our team or, if an agency manages your workspace, to your agency. Support conversations are kept with your account so we can follow up on them.

You should avoid including sensitive personal information in AI prompts or support questions unless it is necessary for your use of the Service and you are authorised to do so.

Our AI service providers' commercial terms do not permit them to use the information we send to train their models.

Our handling of information used with AI providers is subject to our agreements with those providers and this Policy.

10The Reply Assist Browser Extension

Reply Assist is an optional browser extension that helps you post a reply from Localblend on the review site where the review was left.

When you choose to post a reply, Reply Assist receives from your Localblend inbox, in the same browser:

  • the reply text you wrote or chose;
  • the review's public details, such as the reviewer's public name, the star rating, the date, the start of the review and the review site's own identifier for it; and
  • the location's name and the brand name and colour to show.

On the review site, it reads only the window it opened for that reply: the parts of the page needed to find the review and its reply box, and whether your reply has appeared after you press Post.

Reply Assist stores information only in your browser. The waiting reply is deleted after 10 minutes, once it is posted, or when the browser closes. For Google, it remembers which of your signed-in Google accounts manages each location, until you remove the extension; it does not store email addresses or names.

Reply Assist sends nothing to our servers or to anyone else. It tells the Localblend page that asked whether the reply was posted and, if the window was closed first, which step it had reached, as a short code such as "review not found" or "wrong Google account". The Localblend application records the reply as it would any other, and records that outcome against the review, with the review site and the extension's version, so we can find and fix problems with a review site. The outcome never includes anything from the review site's page, the review or your reply, and it is deleted with the review or your account.

Reply Assist never presses Post or submits anything for you, never reads other pages, your browsing history, cookies or passwords, and contains no analytics or tracking.

11Communications and Marketing

We may send administrative messages necessary to operate your account, including security notices, billing information and important Service updates.

We may also send marketing communications where permitted by law.

Marketing emails will include a way to unsubscribe.

Unsubscribing from marketing does not prevent us from sending necessary transactional or account-related communications.

12When We Disclose Information

We may disclose personal information to service providers that help us operate the Service, including providers of:

  • cloud hosting;
  • databases and storage;
  • payments;
  • email and communications;
  • customer support;
  • analytics;
  • monitoring and error reporting;
  • authentication;
  • artificial intelligence; and
  • other infrastructure.

We only provide information reasonably necessary for those providers to perform services for us.

If an agency manages your workspace, that agency's staff can see the information in your workspace, including your reviews, customers and reports.

We may also disclose information:

  • at your direction;
  • to Connected Services you choose to use;
  • where required by law or valid legal process;
  • where reasonably necessary to investigate fraud, abuse or security threats;
  • to protect the rights, safety or property of our users or others; or
  • as part of a merger, financing, acquisition, sale or restructure of all or part of the business, including a transfer to a company we establish to operate Localblend, subject to appropriate confidentiality arrangements.

13Overseas Processing

Some of our service providers may store or process information outside Australia.

The countries in which information is likely to be processed currently include the United States, where our servers are hosted, and member states of the European Union.

The location of processing may change as our providers change.

Where required by applicable law, we take reasonable steps in relation to overseas handling of personal information.

14How Long We Retain Information

We retain information for as long as reasonably necessary to:

  • provide the Service;
  • maintain business and financial records;
  • meet legal and regulatory obligations;
  • resolve disputes;
  • maintain security;
  • prevent fraud; and
  • enforce our agreements.

When information is no longer reasonably required, we will take reasonable steps to delete or de-identify it, subject to legal requirements and normal backup cycles.

15Account Cancellation and Deletion

When your subscription ends, we keep your account and Customer Content so you can pick up where you left off if you return, unless you ask us to delete it.

When you ask us to delete your account:

  • we delete your Customer Content and the personal information we no longer need from our active systems within 30 days of your request;
  • residual copies may remain in protected backups until normal backup rotation removes them; and
  • some records, such as invoices and payment records, are kept for as long as tax, accounting, fraud prevention, dispute resolution or other legal requirements need them.

Your customers' information stays in your account for as long as you keep it there. Deleting a customer from your account deletes their details.

16Security

We use technical and organisational measures intended to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure.

More information is available in our Security Policy.

No method of electronic storage or transmission is completely secure, so we cannot guarantee absolute security.

17Access and Correction

You may ask us to provide access to personal information we hold about you or to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

You can make a request by contacting [email protected].

We may need to verify your identity before fulfilling a request.

There may be circumstances where applicable law permits or requires us to refuse access. If so, we will explain the reason where required.

18Deletion Requests

You may request deletion of personal information by contacting [email protected].

We will respond in accordance with applicable law.

Some information may need to be retained for legitimate legal, security, fraud-prevention or financial-record purposes.

19Privacy Complaints

If you believe we have mishandled your personal information, contact us at [email protected].

Please describe your concern and provide enough information for us to investigate.

We will acknowledge and investigate complaints and aim to respond within a reasonable period.

Where applicable, you may also have the right to complain to a privacy regulator, including the Office of the Australian Information Commissioner.

20Your Privacy Rights in the United States

We do not sell personal information, share it for cross-context behavioural advertising, or use it for targeted advertising.

Depending on the state you live in, you may have the right to:

  • know what personal information we hold about you and how we use and disclose it;
  • receive a copy of it in a portable format;
  • correct it;
  • delete it; and
  • opt out of its sale, sharing or use for targeted advertising, none of which we do.

To make a request, contact [email protected]. We may need to verify your identity before acting on it, and you may make a request through an authorised agent.

If we decline a request, we will explain why and, where your state's law provides one, how to appeal our decision.

We will not discriminate against you for exercising these rights.

Because we do not sell or share personal information or use it for targeted advertising, there is nothing for a Global Privacy Control or Do Not Track signal to opt you out of.

If one of our customers, such as a business you bought from, provided your information to us, we may handle your request together with that customer, as described in section 4.

21Your Privacy Rights in Canada

If you are in Canada, we handle your personal information in accordance with PIPEDA and, where they apply, provincial privacy laws such as Quebec's Act respecting the protection of personal information in the private sector.

You may:

  • ask whether we hold personal information about you, and for access to it;
  • ask us to correct it if it is inaccurate or incomplete;
  • withdraw your consent to our use of it, subject to legal or contractual restrictions and reasonable notice, although we may then be unable to provide some or all of the Service; and
  • ask who has received it.

To make a request, contact [email protected]. We may need to verify your identity before acting on it. We will respond to access requests within 30 days, or tell you within that time if we need longer and why.

The person responsible for the protection of personal information at Localblend is its owner, who can be reached at [email protected].

As described in section 13, some of our service providers process information outside Canada. While it is there, it is subject to the laws of those countries and may be accessible to their courts, law enforcement and national security authorities.

If you are not satisfied with our response to a concern, you may complain to the Office of the Privacy Commissioner of Canada or, where it applies, your provincial privacy commissioner, such as Quebec's Commission d'accès à l'information.

If one of our customers, such as a business you bought from, provided your information to us, we may handle your request together with that customer, as described in section 4.

22Children

The Service is intended for businesses and professional users and is not directed to children.

You must be at least 18 years old to create an account unless we expressly agree otherwise.

23Third-Party Websites

Our Service may link to or integrate with third-party services.

Their handling of personal information is governed by their own privacy policies, not this Policy.

We encourage you to review those policies.

24Changes to This Policy

We may update this Policy when our Service, technology, providers or legal obligations change.

We will update the date at the top of this page when we do.

If a change materially affects how we handle existing users' personal information, we will provide reasonable notice where appropriate.
